Up to Code Plumbing – Terms & Conditions

Up to Code Plumbing (UTC) – Terms, Conditions & Hold Harmless Agreement

By approving this estimate or allowing work to begin, the Customer agrees to the following:

​

1. Authorization to Perform Work

The Customer authorizes Up to Code Plumbing (UTC) to perform the requested services and acknowledges responsibility for payment under the terms outlined herein.

​

2. Payment Terms

Payment is due upon receipt of invoice unless otherwise agreed in writing.

​

UTC covers the cost of materials, parts, and labor upfront.

 

Any unpaid balance after 14 days will incur a 20% late fee.​

​

Approved Payment Methods & Mail Risks: Payments must be made via UTC’s approved electronic methods (e.g., online payment portal, credit/debit card, or direct bank transfer). Utilizing unapproved payment methods, such as sending a physical check by mail, is done at the Customer’s sole risk. UTC is not responsible for delayed, lost, or misdirected mail. If an unapproved payment method results in UTC receiving the funds after the 14-day grace period, the standard 20% late fee will apply without exception.

Accounts unpaid after 30 days may be sent to collections and/or may result in a lien being filed against the property in accordance with Kansas law.

​

Customer agrees to be responsible for any collection costs, legal fees, and administrative expenses associated with recovering unpaid balances.

3. Estimates & Service Policy

UTC currently offers free estimates. This policy is subject to change at any time.

Any additional work required due to unforeseen conditions will be quoted and approved before proceeding whenever possible.

4. Hold Harmless & Indemnification

The Customer agrees to hold harmless, defend, and indemnify UTC, its owners, employees, subcontractors, and representatives from any and all claims, damages, losses, liabilities, or expenses arising from or related to:

​

  • Pre-existing plumbing or structural conditions

  • Aging, corroded, improperly installed, or compromised systems

  • Concealed, hidden, or inaccessible conditions

  • Repairs or recommendations declined by the Customer

  • Work performed at the Customer’s direction against professional advice

  • Attacks, bites, or injuries caused by unrestrained or aggressive pets (as detailed in Section 5)

 

The Customer acknowledges that plumbing systems may fail unexpectedly and that UTC cannot guarantee the condition, performance, or lifespan of existing components.

5. Access to Work Area & Pet Safety

The Customer agrees to provide safe, unobstructed, and reasonable access to all necessary work areas. UTC is not responsible for damage resulting from limited access, unsafe conditions, or structural weaknesses.

​

  • Pet Control & Liability: The Customer agrees to securely contain, crate, or remove all pets from the work area prior to the technician’s arrival and for the entire duration of the service. In the event that an unrestrained, loose, or aggressive pet attacks, bites, or otherwise injures a UTC technician, subcontractor, or representative, the signing Customer assumes full, sole financial responsibility for any and all resulting medical bills, healthcare expenses, lost wages, and legal fees associated with the injury.
     

6. Warranty & Limitations

UTC warranties apply only to labor performed and parts supplied by UTC, unless otherwise stated in writing.

No warranty applies to:

  • Customer-supplied materials

  • Temporary or emergency repairs

  • Pre-existing, deteriorated, or improperly installed systems
     

7. Limitation of Liability

UTC’s liability is limited to the cost of the service provided. UTC is not responsible for:

​

  • Indirect, incidental, or consequential damages

  • Failures occurring after completion of work

  • Water damage, mold, or related issues caused by pre-existing conditions
     

8. Communication Consent

By providing contact information, the Customer agrees to receive service-related communications, including scheduling updates, invoices, and occasional marketing messages. Customer information will not be sold and will only be shared as necessary for business operations.

9. Property Restoration & Environmental Conditions

  • Drywall & Finishes: UTC will make every reasonable effort to minimize damage to surfaces during the course of work. However, UTC is not responsible for the repair, replacement, or restoration of drywall, plaster, paint, wallpaper, tile, flooring, or concrete removed or damaged to access plumbing systems.

  • Landscaping: For any excavation work, UTC is not responsible for restoring lawns, landscaping, shrubs, trees, or paved surfaces to their original condition.

  • Hazardous Materials: If UTC encounters asbestos, mold, lead, or other hazardous materials, work will stop immediately. The Customer is responsible for remediation costs, and UTC is not liable for any delays or exposure claims.
     

10. Drain Cleaning Disclaimer

The Customer acknowledges that mechanical drain cleaning (snaking/rodding) or hydro-jetting involves significant force. UTC is not liable for the failure or collapse of pre-existing pipes that are aged, corroded, cracked, or compromised by tree roots.

​

UTC does not guarantee that a drain clearance will be permanent and offers no warranty on drain cleaning services unless explicitly stated in writing, as blockages are heavily influenced by usage and structural pipe defects.

11. Permits, Utilities, & Excavation

​

  • Permits & Fees: Unless otherwise agreed in writing, the Customer is responsible for securing and paying for any necessary homeowner association (HOA) approvals or municipal permits.

  • Underground Utilities: For any excavation, UTC will contact public utility locating services (e.g., Kansas One Call). However, UTC is not responsible for damage to unmarked or improperly marked private utilities, including but not limited to: irrigation/sprinkler lines, invisible pet fences, low-voltage landscape lighting, or private detached utility lines.
     

12. Governing Law & Severability

This Agreement shall be governed by and construed in accordance with the laws of the State of Kansas. If any provision of this agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
